On November 16th, the Ministry of Commerce stated that the European Commission’s sampling standards for anti-subsidy investigation into Chinese electric vehicles are not in compliance, the sampling process is not transparent, and the sampling results are unfair. Such practices are suspected of violating the rules of the World Trade Organization and European Union laws, and constitute discriminatory actions against Chinese electric vehicle companies. It will greatly distort the results of the subsidy investigation. Reports suggest that the European Union changed its usual practices during the sampling process, only selecting three Chinese domestic companies, which has caused dissatisfaction in the industry.

Spokesperson He Yadong stated that the Chinese side has noticed that the European Commission did not use the representative standard of maximum export volume in the anti-subsidy investigation of Chinese electric vehicles. They only selected three Chinese domestic companies as the sample enterprises. The European Commission’s sampling standards are not in compliance, the sampling process is not transparent, and the sampling results are unfair. Such practices are suspected of violating the rules of the World Trade Organization and European Union laws, and constitute discriminatory actions against Chinese electric vehicle companies. It will greatly distort the results of the subsidy investigation.

In addition, the European Commission excluded EU member companies with high production and sales volume from the sampling of EU industries. This practice goes against the usual conventions, and the sampling results cannot represent the objective situation of the industry within the alliance. The European Commission initiated the anti-subsidy investigation on Chinese electric vehicles without the support of the industry within the alliance, claiming that Chinese electric vehicles pose a threat to the EU electric vehicle industry, completely ignoring the close cooperation between the Chinese and European automotive industries.

He Yadong emphasized that the Chinese industry is strongly disappointed and dissatisfied with the European Commission’s preconceived investigation results and behind-the-scenes operations.
