【PhoneAuto News】On December 18, PhoneAuto noticed that according to “Xinhua News Agency” reports, the Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Public Security, and the Ministry of Justice jointly issued the “Opinions on Handling Criminal Cases of Drunk Driving” (hereinafter referred to as the “Opinions”). The “Opinions” will be implemented starting from December 28, 2023.

Among them, it is mentioned that since the implementation of drunk driving as a criminal offense in 2011, various regions have adhered to strict law enforcement and fair adjudication, punished drunk driving violations and crimes in accordance with the law, and effectively safeguarded the safety of people’s lives, property, and road traffic. The number of fatal traffic accidents caused by drunk driving has significantly decreased. The slogan “Don’t drink and drive, don’t drive after drinking” has gradually become a social consensus, and the control of drunk driving has achieved remarkable results. To adapt to new situations and changes, the “two high courts and two ministries” have conducted in-depth investigations and research, and jointly formulated the “Opinions” by systematically summarizing the law enforcement and judicial experience since the implementation of drunk driving as a criminal offense.

The “Opinions” clearly state that for cases of mild drunk driving, prosecution or conviction exemption may not be pursued; for significantly mild cases with little harm, they may not be treated as criminal offenses and may be subject to administrative penalties in accordance with road traffic safety laws. The “Opinions” establish a sound mechanism for the rapid handling of drunk driving cases, improve the coordination between criminal justice and administrative law enforcement, and establish a hierarchical and progressive drunk driving control system, which better facilitates the organic unity of political, legal, and social effects.
