【Phoneauto News】Previously, Xiaomi applied to the National Intellectual Property Administration to invalidate four Huawei patents. Now there are results in this case.
The National Intellectual Property Administration shows that the case numbers are: 4W115656, 4W115657, 4W115658, 4W115659. On September 1, 2023, the National Intellectual Property Administration declared that the patents are “valid,” and Xiaomi will still need to pay patent fees to Huawei in the future. However, Xiaomi can file a lawsuit with the Beijing Intellectual Property Court within three months.
In fact, Xiaomi has previously initiated multiple requests to invalidate Huawei’s patents. In May of this year, the National Intellectual Property Administration announced that Xiaomi recently initiated an invalidation request for a Huawei patent titled “A method and terminal for obtaining panoramic images.” In July, Xiaomi also initiated an invalidation request for Huawei’s patent “ZL201810188201.7,” which is titled “A lock screen method and mobile terminal.”

In July, Huawei made a big move by expanding the scope of patent licensing fees from smartphones to areas such as smart homes and smart industries.
According to reports, at the 2023 Innovation and Intellectual Property Forum held on July 13, Huawei announced the patent licensing rates for its smartphones, Wi-Fi, and Internet of Things. Among them, the maximum licensing rates set by Huawei for 4G and 5G smartphones are $1.5 and $2.5 per device, respectively. The licensing rate for Wi-Fi 6 consumer devices is $0.5 per device. For devices with Internet of Things technology as the core, Huawei sets the licensing rate at 1% of the net selling price, with a maximum rate of $0.75 per device. As for devices enhanced by Internet of Things connectivity, the licensing rate is between $0.3 and $1 per device.
